A coastal statute, enacted and left on the shelf for two and a third years.
The commencement order is two numbered paragraphs. The Act it switched on runs to 85 sections across 12 Parts with two Schedules, replaces the law that governed Guyana's sea defences, and creates a board that did not previously exist in statute.
What did the order actually do?
Appointed 7 October 2026 as the date the Act came into operation, and nothing else.
Order No. 188 of 2026 is the whole of the subsidiary legislation in the Legal Supplement of the Official Gazette of 17 October 2026, which records ACTS, NIL and BILLS, NIL. It is made under section 2 of the Sea and River Defence Act 2024, cited as the Sea and River Defence Act 2024 (Commencement) Order 2026, and reads:
"I appoint the 7 day of October, 2026 as the date on which the Act shall come into operation."
It was made on 7 October 2026 by the Minister of Public Works.
How long did the Act wait?
Twenty-eight months between enactment and commencement.
| Step | Date |
|---|---|
| Passed by Parliament | 17 May 2024 |
| Published, Official Gazette Legal Supplement A | 24 May 2024 |
| Brought into operation | 7 October 2026 |

Through those 28 months the repealed law continued to govern the coast.
What does the Act replace?
Both chapters of the previous sea defence law, together.
Section 85 repeals the Sea Defences Act, Chapter 64:01 and the Sea Defence Act, Chapter 64:02, each subject to section 84. Section 83 preserves any sea or river defence already in existence under either Act immediately before commencement.
The long title states the purpose:
"AN ACT to repeal and replace existing legislation on sea and river defence, to make provision for protection from inundation from the sea or rivers and to provide for the establishment, construction and maintenance of sea and river defences, natural defences and to provide for related matters."
Natural defences appear in the long title itself. When the Bill was passed in May 2024, opposition MP Amanza Walton-Desir raised inconsistencies in the Act's definition of sea and river defence, particularly as it concerned natural defences, and urged that vulnerable populations be prioritised.
What is the Sea and River Defence Board?
A Minister-appointed body charged in statute with the care, maintenance, management and construction of Guyana's sea and river defences.
Part II establishes it across sections 5 to 10, covering its functions, a secretariat, funds, an annual report and a power to make by-laws. Schedule I constitutes it. Members serve three-year terms and may be re-appointed.
| Schedule I requires | Minimum |
|---|---|
| Members from other Government bodies, or their nominees | at least 5 |
| Members representing a Regional Democratic Council | at least 3 |
| Other members, including at least one private sector and one non-governmental | at least 3 |

Nine Government offices are then named against that floor of five: the Chief Officer, the Chief Executive Officer of the Central Housing and Planning Authority, the Commissioner of the Guyana Lands and Surveys Commission, the Chief Executive Officer of the National Drainage and Irrigation Authority, the Commissioner of the Guyana Forestry Commission, the Director of the Maritime Administration Department, the Director-General of the Civil Defence Commission, the Executive Director of the Environmental Protection Agency, and the Senior Director of the Department of Environment and Climate Change.
On composition, Schedule I provides that decisions "shall strive for an adequate gender balance, reflecting national policy objectives as may be specified from time to time". In May 2024 opposition MP David Patterson disputed the government's account of gender balance on the previous board, producing documentation showing 8 of 20 members were women.
What can get a member removed?
Five named grounds, Cabinet concurrence, and one that concerns speech.
A member may be suspended or removed by the Minister with the concurrence of Cabinet, and only on the grounds Schedule I lists: "incompetence, disability, bankruptcy, neglect of duty, or misconduct or if the member, having dissented from a majority decision of the Board, publicly criticises the decision of the majority."
Removal is separately mandatory where a member or their alternate misses three consecutive meetings without the Board's leave.
What else switched on that day?
Eleven further Parts, including powers to enter land, serve flood protection notices and levy administrative penalties.
| Part | Subject | Sections |
|---|---|---|
| III | National sea and river defences | 11-22 |
| IV | Local sea and river defences | 23-33 |
| V | Waterfront development zones | 34-37 |
| VI | Information and public participation | 38-41 |
| VII | Authorised officers | 42-49 |
| VIII | Flood protection notices | 50-55 |
| IX | Offences | 56-69 |
| X | Administrative penalties | 70-75 |
| XI | General and miscellaneous | 76-82 |

Three provisions bear directly on property and access. Section 18 makes sea and river defence zones the property of the State. Section 14 requires public consultation on a draft sea or river defence plan. Section 38 applies the Access to Information Act to the regime. Part IV allows a proprietor to raise money for protection from water, with loans and a preferent lien for the amount. Section 22 provides that expenditure for sea defences is to be provided by Parliament.
Part IX creates the offences, which include damage to a defence, making a drain into the sea, obstruction, removal of earth and shell, trespass of cattle, forfeiture, liability for loss and damage, damage caused by vessels, and strict liability.
What does this mean for the rest of the Caribbean?
That the gap between a law being passed and a law being in force is itself a measurable thing, and it can be measured from the gazette.
Guyana's populated coastal plain lies below the level of the spring tides, which makes sea and river defence a question of national survival rather than of infrastructure policy. The instrument governing it was replaced in Parliament in May 2024 and the replacement did not take effect for 28 months. Both facts are on the public record, each in its own gazette, and the second is only visible to a reader who opens the Legal Supplement of a Saturday issue.
Guyana's gazette has carried the acquisition of a road corridor and the transfer of state land to the housing authority in the same month, examined in Order 182 Takes 77 Acres for the Heroes Highway Extension and Five Orders Moved 2,368 Acres to the Housing Authority. The same issue that carried this commencement order also declared two public holidays, in Deepavali Falls on a Sunday This Year.
