The accord calls the measure temporary and orders a financial analysis by 10 April 2027." ---

Mexican outlets reported a cap, a freeze and a suspension. The instrument in the Diario Oficial is titled as the approval of an analysis.
What did the accord actually change?
The salary a worker may keep contributing on after leaving employment.
The Consejo Técnico of the Instituto Mexicano del Seguro Social adopted accord ACDO.AS2.HCT.101026/302.P.DG in extraordinary session on 10 October 2026, and it was published in the Diario Oficial de la Federación on 21 October. It governs the Continuación Voluntaria en el Régimen Obligatorio, the route known colloquially as Modalidad 40 after its number in the Institute's catalogue of procedures.
Under the accord, a person finishing a contracted period, or wishing to preserve pension rights, may enrol at the "último salario base de cotización registrado al momento de causar baja en el régimen obligatorio o hasta el importe de éste, más una Unidad de Medida y Actualización", an amount that may never fall below the general minimum wage.
The Unidad de Medida y Actualización is a reference figure the national statistics institute resets each year. INEGI set it at 117.31 pesos a day for 2026, with effect from 1 February, a rise of 3.69 per cent on 2025.
Reforma, El Norte and Diario de Juárez reported that the previous arrangement let a worker choose a contribution salary above the last one earned, up to a ceiling of 25 UMAs. At the 2026 value that ceiling is about 2,932 pesos a day, and it is a daily figure rather than a monthly one. Reforma reported that the route had allowed some workers to secure pensions above 80,000 pesos a month. Neither the old ceiling nor those pension amounts appears in the accord.
Two further restrictions sit in the same text. New enrolments take effect only from the date of application, with no backdating. And enrolment must be made "únicamente mediante mecanismos digitales que garanticen la trazabilidad y consistencia de los registros afiliatorios", with a separate channel to be designed for special cases.
Is the measure permanent?
No. The accord describes it as temporary and sets two deadlines for replacing it.
Point four opens with the words "Como medida temporal, y hasta que se cuente con el análisis a que se refiere el punto segundo", and states that the governing body will decide whether the measure continues once that analysis is before it.
| Step the accord orders | Who | Deadline |
|---|---|---|
| Analysis of the modality's effect on the Institute's finances | Dirección de Finanzas, through the Unidad de Riesgos Financieros y Actuariales | within 6 months of the accord, so by 10 April 2027 |
| Proposed amendment to the rules, to make the modality "viable en el mediano y largo plazos" | Dirección Jurídica | within 6 months of receiving those results |

The accord was issued on 10 October 2026, which fixes the first deadline. The second runs from receipt rather than from a calendar date, so if the analysis arrives on its own deadline the proposal could fall as late as around October 2027. That is an outer bound derived from the two periods, not a date the accord states.
The full title of the instrument is the approval of "el análisis del efecto de la Continuación Voluntaria en el Régimen Obligatorio del Seguro Social y de las respectivas medidas temporales". The study is the object; the restriction is the interim.
Who is affected, and who is not?
People joining or rejoining. Those already enrolled keep their terms.
Anyone enrolled when the accord took effect "permanecerán en dicha modalidad, en las condiciones actuales, hasta la conclusión del periodo que tengan contratado". The narrower basis applies at the end of that period and to new entrants.
The accord also preserves what has already been paid for. Those enrolled at entry into force "conservarán el reconocimiento de las semanas y salarios cotizados efectivamente pagados, los cuales surtirán plenos efectos para el cálculo de sus derechos pensionarios futuros".
One group is excluded outright. People in the modality under article 13, fracción I of the Ley del Seguro Social may not contract Continuación Voluntaria, and the accord gives its reason: that route lets them keep the benefits attached to the Seguro de Enfermedades y Maternidad, which this one does not.
When did it take effect?
The working day after publication, which the accord states and the reporting split on.
Point seven reads: "El presente Acuerdo entrará en vigor el día hábil siguiente al de su publicación en el Diario Oficial de la Federación." Publication was Wednesday 21 October 2026, so entry into force was Thursday 22 October 2026.
La Jornada reported that it took effect on the day of publication. Informador and Uno TV reported 22 October. The text supports the second.
Who says the board could not do this?
A senator, on the floor, the same day it was published.
Senator Claudia Anaya Mota of the Partido Revolucionario Institucional raised the accord during the Senate's ordinary session on 21 October, describing it as suspending Modalidad 40 "para acceder a una pensión más justa", El Universal reported.
"No es la primera vez que a este gobierno le da por legislar a decretazos. No está dentro de las facultades del Consejo Técnico del IMSS poner en suspensión artículos puntuales de la ley."
She asked the chamber to act: "Es importante que desde este Congreso se haga algo." The President of the Senate's Mesa Directiva, Higinio Martínez, replied that "atendiendo el planteamiento turnamos el asunto a la Junta de Coordinación Política para lo revise de manera inmediata", El Universal reported.
The accord sets out its own authority in its opening paragraph, citing articles 251, 263 and 264 of the Ley del Seguro Social, articles 5 and 57 of the Ley Federal de las Entidades Paraestatales, and article 31 of the Institute's own Reglamento Interior.
How does this sit beside other pension systems in the region?
Three states, three different pressures on the same promise, all reported in the past six weeks.
| State | The pressure, as reported |
|---|---|
| Mexico | A top-up route narrowed by board accord, expressly temporary, with an actuarial study ordered |
| Antigua and Barbuda | The most recent actuarial review the Social Security Board publishes is as at 31 December 2014 |
| Guyana | Workers reaching pension age with employer contributions never remitted |
Sources: La Caribeña News reporting of 17 September and 26 October 2026, and the accord.
In Antigua and Barbuda, the last published actuarial review of the Social Security Fund records no liquid assets and benefit payments late for a third consecutive year, as this newspaper reported today, while the Cabinet decides on Wednesday whether to ask that fund for up to 20 million dollars toward a hotel.
In Guyana, the Finance Minister told the National Insurance Scheme to find missing employer contributions before workers reach pension age, this newspaper reported in September, in a scheme where an old age pension requires 750 contributions.
What Mexico's accord adds to that picture is an instrument that says in its own words what it does not yet know. It orders the actuarial work and restricts the route while the work is done, rather than the other way round.
What has not been established?
Four things, and the accord supplies the reason for the first.
The financial effect. The analysis that would quantify it has been ordered and is not due until April 2027.
Whether the measure survives. The accord makes continuation a decision for the governing body once that analysis is before it.
Whether the Consejo Técnico held the power. The matter was referred to the Junta de Coordinación Política on the day of publication, and no finding has been reported since.
The number of people affected. No figure for current or prospective enrolment in the modality appears in the accord or in the reporting of it.
A board ordered a study, restricted a route while the study runs, and gave itself until April to learn what the route costs. Another Mexican authority has just set a charge aside without publishing the rules: Mayor Ana Paty Peralta announced Renueva Cancún at the Cancún Travel Mart on 22 October 2026, under which hotels may be exempted from remodelling licence fees.

Frequently Asked Questions
What did the IMSS accord of 21 October 2026 change?
It tied contributions under the Continuación Voluntaria route, known as Modalidad 40, to a worker's last registered base contribution salary plus one Unidad de Medida y Actualización, never below the general minimum wage. New enrolments take effect only from the date of application and must be made through digital channels.
Is the Modalidad 40 restriction permanent?
No. The accord describes it as a temporary measure lasting until an analysis of the modality's effect on IMSS finances is before the governing board. That analysis is due within six months of the accord of 10 October 2026, so by 10 April 2027, after which the board decides whether the measure continues.
Does the change affect people already enrolled?
No. Those enrolled when the accord took effect keep their current conditions until the end of the period they contracted. The accord also preserves recognition of the weeks and salaries already paid for, which continue to count toward future pension rights.
When did the IMSS accord take effect?
On Thursday 22 October 2026. The accord states it enters into force on the working day following publication in the Diario Oficial de la Federación, and publication was Wednesday 21 October. Mexican outlets split on this, with one reporting it took effect on the day of publication.
Why is the Senate examining the accord?
Senator Claudia Anaya Mota told the Senate on 21 October that suspending specific articles of the law is not within the Consejo Técnico's powers. The President of the Mesa Directiva referred the matter to the Junta de Coordinación Política for immediate review. The accord cites articles 251, 263 and 264 of the Ley del Seguro Social as its authority.
